These Terms of Service (the “Agreement”) set forth the terms and conditions of Your Use of hosting and related services (“Services”). In this Agreement “You” and “Your” refer to You as the user of Our Services, or any agent, employee, servant or person authorized to act on Your behalf. “We”, “us” and “our” refer to Viewen.com., as well as its subsidiaries and sister companies. This Agreement explains Our obligations to You, and explains Your obligations to Us for the various services or products offered by Viewen.com (“Services”). When You use Your account or permit someone else to use it to purchase or otherwise acquire access to additional Services or to cancel Your Services (even if We were not notified of such authorization), You signify Your agreement to the terms and conditions contained in this Agreement.

Account Registration and Eligibility

To use our Services, you must:

  • Be at least 18 years old or the legal age of majority in your jurisdiction.

  • Provide accurate and complete information during registration.

  • Maintain the confidentiality of your account credentials.

You are responsible for all activities that occur under your account.

Customer’s Valid Contact Details:

Accurate Information Requirement
All customers are required to provide complete, accurate, and verifiable contact information, including a valid full name, physical address, and phone number (mobile or landline) at the time of registration. This information must remain current at all times.

Our team conducts periodic reviews of customer profiles to ensure compliance with our identity verification standards. If any customer details are found to be incomplete, inaccurate, or unverifiable, Viewen reserves the right to request official documentation to confirm identity and address. Acceptable documents may include, but are not limited to:

  • Government-issued photo ID (Passport, Aadhaar Card, PAN Card, Voter ID, Social Security Card)

  • Proof of address (Utility bill, bank statement, or similar official correspondence)

International customers must provide a valid Passport as proof of identity and address.

Failure to Comply
Failure to provide accurate information or refusal to submit the requested documentation may result in:

  • Temporary suspension of the account

  • Permanent termination of services

  • Forfeiture of any payments made (no refunds will be issued)

Use of Fake or Placeholder Information
The use of fictitious or misleading information, such as false names (“Aaadfdf Ffdfsf”), non-existent addresses (“44444444 Parck Rd”), or invalid phone numbers, is strictly prohibited. Such entries indicate a lack of intent to comply with our Terms of Service and may be treated as a willful breach of policy.

Viewen takes the integrity of its platform seriously. Accounts found to be in violation of this clause may be terminated without notice and without refund.

Acceptable Use Policy:

You agree not to use our Services for:

  • Hosting or distributing malicious software (e.g., viruses, worms, Trojan horses)
  • Engaging in DDoS attack, phishing, spamming, or unsolicited bulk messaging/mass mailing
  • Hosting adult content, proxy/torrent scripts, or unauthorized file storage
  • Selling unauthorized pharmaceutical products.
  • Violating any applicable laws or regulations
  • We reserve the right to suspend or terminate accounts that violate this policy

Data Protection, Backups, and System Maintenance

Backups and Customer Responsibility:
Viewen.com provides daily and weekly hosting account backups as part of our standard service offering. These backups are maintained on a best-effort basis using reliable server infrastructure. However, clients are strongly advised not to rely solely on our backup systems. Despite our measures, hardware failure or other unforeseen issues may lead to data loss or corruption.

In today’s digital landscape, website hacking and cyber threats are a serious concern. While we implement security practices to safeguard customer data, no web environment is 100% immune to breaches, compromises, or malware attacks. We recommend reading reputable online resources to remain informed and vigilant.

In the event of a security breach or website compromise:

  • We will make every reasonable effort to restore your website using the latest available backup.

  • We do not guarantee full or partial restoration of data to the exact previous state.

  • If the latest backups are unusable, we may restore from the most recent viable archive, which could be the delivery-day backup.

Customers are solely responsible for maintaining regular backups of their websites—particularly after making changes or updates. We recommend downloading a local copy to your device or cloud storage on a weekly basis or after any significant updates.

Limitation of Liability for Data Loss:
Viewen.com shall not be held liable for any form of data loss, data corruption, or damage—whether partial or total—caused by, but not limited to:

  • Hardware or system failure

  • Cyber-attacks or unauthorized access

  • Accidental deletion or customer error

  • Acts of force majeure (e.g., natural disasters, fire, power failure)

The customer is solely responsible for ensuring critical data is securely backed up independently i.e, download and store full backup on local drive or cloud storage, Google Drive.

Maintenance and Service Downtime:
To ensure ongoing performance, security, and stability, we conduct routine and emergency:

  • Server upgrades

  • Software updates and testing

  • Module deployment and patching

As part of these activities, temporary service disruptions may occur. While we aim to provide at least 24 hours’ notice prior to planned maintenance, this may not always be feasible in urgent scenarios.

Downtime resulting from such maintenance activities:

  • Will not be counted as server downtime or service-level violation.

  • Is essential to uphold the long-term reliability, performance, and security of our infrastructure.

We continuously work to enhance our infrastructure, implement the latest security practices, and deliver a robust hosting environment for all our clients.

Emails Services:

Emails sent through our servers may be marked as spam if:

  • Proper DKIM and SPF records are not configured.

  • Daily/hourly sending limits are exceeded.

We recommend using external email services like SendGrid for mass mailing or critical communications.

Malicious Website or Website Hacked:

We provide Imunify360 Malware & Virus Protection software. As you are the owner of your website, it is your responsibility to make your website secure by regularly scanning your site. We will not take any kind of responsibility if your website gets infected or hacked. We have add-on packs to secure your website from our end for one time.

Taxes

Viewen will not be liable for any taxes or other fees to be paid following or related to purchases made from the Customer or Viewen’s server. Customer agrees to take full responsibility for all taxes and fees of any nature associated with such products sold.

Payment:

Delcid LLC, Viewen, and its subsidiaries reserve the right to suspend the services if the payments are not made by the due date. We shall not be held liable for any kind of loss due to the disruption of services. Our pricing may increase or decrease at any time or situation if any third-party software license price increases or decreases like Softaculous, CloudLinux, LiteSpeed, SiteBuilder, cPanel, Plesk, CWP, etc. In some cases, if third-party or base software or application price increases or decreases then existing customers or new customers & whoever will or had purchased our hosting has to pay extra cost expenses because our pricing is dependent on all these third-party software licenses.

Service Charges:
Service handling charges or Service charges apply to all the customers on our platform on all the plans. It is applicable to all customers (new + old customers).

What are service handling charges?

A service charge is an additional charge for the service provided with the purchase of a product or service. A service charge is a fee collected to pay for services related to the primary product or service being purchased. The charge is usually added at the time of the transaction.

Many industries collect service charges, including restaurants, banking, and travel and tourism. When collected, these charges may cover services rendered to the consumer, or they may cover administrative or processing costs. Service charges are paid directly to the company. They are different from tips, which are paid to the employee who renders the service.

Service charges are additional charges related to the purchase of a product or service. They are generally collected at the time the transaction takes place between the consumer and the company. For example, a concert venue may charge a service fee in addition to the initial price of a ticket at the time of purchase in order to cover the cost of security or for providing the convenience of electronic purchases.

Service charges are also called service fees. They go by a number of different names depending on the industry, including booking fees (hotels), security fees (travel), maintenance fees (banking), and customer service fees.

Existing customers having PayPal Subscription or any Automatic Payments Subscription are requested to update their subscription plan on their payment platform like PayPal. We will not take responsibility in case of suspension or termination of account due to a price mismatch in subscription plan and service plan fee as after the addition of service charges Invoice total amount will be increased by 4.4%.
Plan Fee + Service Handling Charges (4.4%).
 
If/When any customer contacts us or raises a complaint regarding the suspension of account or termination of account due to mismatch in subscription fee and total invoice fee, we may update your Active subscription on PayPal or a related payment platform from our end. We may update the subscription without prior notification to avoid any kind of inconvenience like suspension of the account.
 
Renewal Policy:
As we offer only Prepaid Subscription, Viewen reserves the right to change its pricing.
If your renewal price is high, it’s because we ran a promotion during the first plan period. This offer is for a limited time and cannot be extended.

Service Status Definitions

When you purchase or manage services with us, your service may fall under different statuses based on its lifecycle and any actions taken. Below are explanations of the various statuses you may encounter:

  • Pending:
    This status indicates that your service has been ordered but is not yet activated. It may be awaiting payment, manual approval, or some other action before it can become fully operational. No resources are allocated during the pending status.

  • Active:
    A service is considered active when it is fully operational and available for use. You will have full access to all features and resources associated with the service. Billing for the service also begins when it reaches this status.

  • Suspended:
    A suspended status occurs when the service is temporarily disabled, usually due to unpaid invoices, a breach of terms of service, or other violations. While suspended, you will not have access to your service or its associated resources until the issue is resolved. However, your data and configurations remain intact. Services are automatically suspended if an invoice is not paid by the due date. Please note, even while suspended, services will continue to generate invoices until a formal cancellation or termination request is submitted.

 
  • Terminated (Deleted):
    This status means the service has been permanently deactivated and all associated resources, including files, databases, and settings, have been deleted. This often follows a cancellation request or prolonged suspension. Please note: Data cannot be recovered once a service is terminated.

  • Fraud:
    If a service is marked as fraud, it means that the order or account is suspected of fraudulent activity. This status is used when our systems or manual reviews flag an order as potentially risky, typically due to suspicious payment behavior, fake details, or violation of legal policies. Services under this status are not activated and may lead to account suspension or termination.

  • Cancelled:
    A cancelled status indicates that you have requested the service to be stopped, and it will no longer be billed. Depending on the timing, the service may remain operational until the end of the current billing cycle, after which it will be deactivated and moved to terminated status.

Important Notice on Service Continuation and Billing

Please be advised that an active service will remain operational and billable until a cancellation request is submitted by the user.

If you do not wish to continue using a service or do not intend to pay for an outstanding invoice, it is essential that you submit a cancellation request. Failure to do so will result in continued invoicing for the service, and the charges will remain applicable.

Additionally, if you have saved a payment method on file (e.g., a credit card or PayPal subscription), automatic payments may be processed for any unpaid invoices.

Please note that any available account credits will be automatically applied to outstanding invoices. Refunds are not available after 7 days from the activation of the service.

Invoicing:

Invoice Generation and Payment Reminder Policy:

Viewen generates invoices 10 days prior to the due date to ensure timely payment. We will send three reminders to notify you of the pending invoice and request payment completion.

Accounts will be suspended if payment is not received by the due date or if any invoice related to the service remains unpaid. Reactivation fees may apply, depending on the type of service, the customer’s payment history, and whether technical support or third-party software is involved.

Payment Methods:

We have many payment gateways,
For international, we have PayPal & Stripe. For Indians, we have Instamojo & RazorPay (Official UPI: aadarshking@ybl).


No other staff is allowed to accept payments directly in their personal account/UPI. A customer is required to make payments using the invoice created.

Billing Agreement and Account Management Policy

When you place an order with us, you enter into a Billing Agreement based on your selected payment cycle (Monthly, Quarterly, Semiannual, or Annual). This agreement requires you to keep up with your payments on time to avoid service Termination or Cancellation.

  • Billing Responsibility: You are obligated to pay all invoices on time. If your account is suspended, it is due to non-payment, and the responsibility lies with you. Similarly, if your account is terminated, it is because of continued non-payment—our system automatically terminates accounts 60 to 90 days after the due date, considering it a breach of the Billing Agreement.

  • Account Reactivation: Accounts will not be activated or reactivated without settling any outstanding payments.

  • Account Information Accuracy: Accounts may not be activated if the signup information is incomplete, incorrect, or appears suspicious. In such cases, your account may be placed on hold for up to 72 hours (or in rare cases, up to one week) while we review the provided information.

  • No Responsibility for Losses: Viewen is not responsible for any losses or expenses incurred due to actions taken in response to non-payment. It is the customer’s responsibility to ensure timely payments to avoid service interruptions.

  • Data Deletion Upon Account Cancellation: When an account is cancelled (whether cancelled, terminated, or deleted), all associated website files, data, and email content are permanently deleted from our servers. If you need data recovery (when backup is available on the backup server) after cancellation, a recovery fee of a minimum $50.00 may apply to cover our time and effort. Reactivation Fees for Managed Servers and services are custom generated  depending on the concerned service, support, etc.

  • Viewen Credits Policy: Viewen credits are non-refundable and serve as a convenient payment method for handling your invoices, bills, and service purchases. By using Viewen credits, you can make payments with a single click, bypassing the need to enter card details or set up a PayPal subscription. Enjoy effortless transactions by simply using your credits to access the services you need.
    – Credits are allowed to be used on Invoices generated for Hosting Services only. Applicable Hosting Services: Web Hosting, Cloud Hosting, Prime Hosting, WordPress Hosting.
    – To safeguard our policy and to avoid the use of stolen credit and debit cards, applying credits on invoices generated for domain registration, reseller hosting, multidomain hosting, managed servers, and services is strictly banned.

Viewen.com Hosting Plan Upgrade and Downgrade Terms and Conditions:

These terms and conditions govern the policies for upgrading and downgrading hosting plans on Viewen.com. By requesting an upgrade or downgrade, customers agree to abide by the following policies:

1. Upgrade and Downgrade Eligibility

  • All hosting plans are eligible for an Upgrade subject to plan/stock/service/server availability
  • One Change Per Year: Accounts are eligible for downgrade once within a billing cycle
  • Restrictions on Downgrades: To protect our Billing Terms & Agreement and prevent misuse of coupons and offers, downgrades from Cano plan to Swift or Swift Lite plans are only permitted at the end of the current billing cycle. Additionally, accounts using a discount coupon of 50% or more at the time of purchase, or during any prior upgrade or downgrade, are not eligible for price adjustments on downgrades.

2. Downgrade Policy

  • End-of-Cycle Downgrades Only: All downgrades must be requested on or before the Next Due Date and will only be processed at the end of the current billing cycle.
  • No Price Adjustments on Downgrades: As price adjustments on downgrade function as refunds, they are not offered on downgrades. Any remaining balance from the original plan will not be refunded or credited back or used to adjust due date.

  • Non-Refundable Balances: Any balance remaining after a downgrade is non-refundable and will not be credited toward future billing cycles.

3. Upgrade Policy

  • Immediate Activation and Pro-Rated Billing: Upgrades take effect immediately, with any applicable pro-rated charges adjusted to reflect the new rate for the remaining period in the current billing cycle.
  • Conditional Price Adjustments: Price adjustments on upgrades are calculated on a pro-rated basis, covering the remaining period of the billing cycle.
  • Chargeable Technical Assistance: Technical assistance for upgrades, such as the removal or addition of domains, website migrations, website transfers, or data restoration from backups, is available at an additional charge. Please contact support for details on specific service fees.

4. Data Restoration and Migration Services

  • Data Restoration: Requests for data restoration are subject to a service charge. Please reach out to support for information on applicable fees.
  • Data Migration: Migration of data from one server to another is also a chargeable service. For details, contact support regarding this migration service fee.

5. General Conditions

  • Policy Modifications: Viewen.com reserves the right to modify these terms and conditions at any time. Changes will be communicated through our website or to the customer’s registered email.

By initiating an upgrade or downgrade request, customers confirm they have read, understood, and accepted these terms and conditions. For any questions, please contact our support team at one@viewen.com.

Why Payment is Required If Suspended

Payment is still required for a suspended account because resources are allocated and services are provided the moment your order is activated. This includes licensesserver space, and data storage, which are reserved specifically for your account.

Even if your account is suspended, we continue to keep your data safe and secure, and it still occupies disk space and utilizes our resources. Therefore, it’s inaccurate to claim that you haven’t used the service just because the account is suspended.

The suspension occurred because you did not fulfill the payment obligations under the Billing Agreement, and payments must still be made as agreed.

Why Payment is Required If Terminated

Post-Termination Options and Data Restoration

If your account is terminated, you have two options:

  1. You can request the deletion of the previous service and place a new order using the same domain.

  2. If you prefer to continue with the previous order and need your data restored, you must first clear all outstanding invoices. Restoration charges will apply for data recovery.

Please note that a new order using the same domain cannot be placed until the previous service is fully deleted.

Why Viewen Charges for Data Restoration

Even after your account is terminated, we take significant measures to safeguard your data. This includes allocating server space and keeping your data secure up until the last day. Additionally, we maintain multiple backup instances on separate servers, all stored in a highly secure environment to ensure data recovery in case of emergencies.

We incur substantial costs to maintain this backup infrastructure, including server fees, security measures, and ongoing maintenance. These resources are dedicated to your account, and your data continues to occupy valuable disk space, even after service suspension or termination. This is why restoration of data incurs additional charges.

Payment Obligations and Notifications

Termination or suspension occurs because the Billing Agreement was not honored. You were also notified multiple times via email regarding account suspension due to non-payment, but no action was taken.

What do you mean by “Unlimited”?

What we mean is, you don’t have to worry about disk storage or network transfer when your site gets popular.

You DO still have to worry about plenty of other things though… if your site isn’t well optimized and is causing issues for others on your shared server (either because it’s pounding the CPU, hogging RAM, or doing tons of disk I/O), you may be asked to sign up for your own Viewen Server.

Trust us, every host out there has the same limitations… we’re just trying to be upfront about them!

What about databases?

You’re certainly allowed an unlimited number of MySQL databases, but in the interest of server stability, we request that you try to keep them optimized and no larger than a few GB in size.

…and Unlimited email?

The Unlimited Policy doesn’t apply to email. Any new email addresses will have a 100 MB – 15 GB limit, and we’ll be enforcing these limits on all accounts if it gets out of hand!

What’s not allowed in “Unlimited”?

Basically, sites whose essential purpose is to use disk or bandwidth. When making a website, you should be thinking about “How can I make an interesting site for my visitors while minimizing my disk storage, bandwidth, file system, memory, and CPU impact as much as possible?”

The result will be a better experience for your visitors, your web host, and yourself!

Here are some specific examples of things not allowed:

*Copyrighted content to which you do not hold usage or distribution rights.
*File upload / sharing / archive / backup / mirroring / distribution sites.
*A site created primarily to drive traffic to another site.
*Making your account resources available (whether for free or pay) to the general public.

Viewen reserves the right to delete data stored on our servers that violates any of the terms in the Unlimited Policy, and, generally, in our Terms of Service. Viewen has sole discretion to determine what does and does not violate either policy.

Actually, for you, my dear Legitimate Website Owner, it is unlimited.

This whole page is just to announce to the <.1% of people who want to try and run free porn affiliate sites or anime video trading forums or host pirated rips of The Dark Knight on Viewen that we’re not having any.

But our pledge to you is to do our best to always keep your website, with the content you created, UP… no matter how many times you get Slashdotted or Reddited.

Third-Party Content:

If You elect to sell or resell advertising or webspace to a third party then You will be responsible for the contents of that advertising and the actions of that third party. Viewen has the absolute right to reject any advertising or other third party content that is illegal, offensive, or otherwise in breach of the then-current Viewen policy or agreement. Such content may result in the suspension or in the immediate termination of Your account. You are responsible for monitoring all service renewals and orders. In the event that an error occurs the account holder must notify Viewen immediately of the error. In no event shall Viewen be liable to the Account Holder for any damages resulting from or related to any failure or delay of domain registration, transfer or renewal.

Third-Party Software:

Our Services may include third-party software (e.g., cPanel, Microsoft Windows). By using such software, you agree to comply with its respective terms of service. Viewen.com is not responsible for issues arising from the use of third-party software.

Actions Taken by Viewen:

The failure by a customer to meet or follow any of the terms & conditions is grounds for account deactivation. Viewen will be the sole arbiter as to what constitutes a violation of the term & condition. Viewen reserves the right to remove any account without prior notice and to refuse service to anyone at any time. Depending on the severity of the violation, Viewen may, at its sole discretion, restrict, suspend or terminate a customer’s web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, Viewen will notify the appropriate law enforcement authorities of such violation. Viewen does not issue credits for outages incurred through service disablement resulting from Term & Condition violations. Viewen customers agree to indemnify and hold Viewen harmless from any claims resulting from the use of our services that damages them or any other party.

Legal:

The laws of the US will govern this agreement. In any event of a dispute, the area of Jurisdiction would be Houston, Texas only.

We support your Freedom of Speech and expression; however, we ask that you understand that responsibility is associated with this right. These terms may be changed at any time without notice to you. You agree that all changes after your signup still fully apply to you and it is your responsibility to check the terms of service often.

We reserve the right to modify these terms and conditions.
